Important Licensing Clarifications
1. Image Use vs. Advertising Use
Image Use
(included in the Business License)
Image use refers to the use of an image to represent a brand’s visual identity without paid distribution or promotion.
This includes:
• organic social media posts (non-paid reach)
• placement on official company websites
• catalogues, presentations, annual and corporate reports
• interior decoration of offices and commercial spaces
• PR materials, press releases, and editorial publications
This type of use serves brand representation and does not constitute advertising.
Advertising Use (Paid Media)
Advertising use is not included in the Standard or Business License.
It is available only:
• a separate paid add-on to the Business License
• fully included under License 3 (Extended / Exclusive Commercial License)
Advertising use refers to any format in which the company pays for the distribution of the image to a target audience,
including:
• targeted social media advertising (Instagram, Facebook, TikTok)
• contextual advertising (Google Ads, YouTube Ads)
• outdoor advertising (billboards, city formats, transport advertising)
• print advertising in magazines and newspapers
• banner networks and large-scale digital campaigns
Why this matters:
Advertising campaigns involve direct commercial exploitation of a specific visual asset.
Licensing fees for advertising use are calculated individually based on territory, duration, and media budget.
2. How to Determine the Appropriate License
(practical guideline)
1. Company size
• private individual or single location / office → Standard License
• brand, network, or corporation → Business License
2. Role of the image
• illustration for an article, blog, or local brochure → Standard License
• hotel interiors, annual report covers, corporate catalogues → Business License
3. Why the Same Medium May Require Different Licenses
• brochure for a local florist → Standard License
• brochure for Mercedes-Benz or Hilton → Business License
The value of image usage increases with the scale, reach, and market presence of the company.
4. Information Required for License Assessment
To prepare an accurate proposal, please provide:
1. company size
2. intended use of the image
3. whether advertising (Paid Media) is planned
4. territory and intended duration of use
5. When License 3 Is Required
(Extended / Exclusive Commercial License)
License 3 applies when an image is used not merely for brand representation, but becomes part of an advertising
campaign or a commercial product.
This license includes full advertising rights and is designed for projects in which the image actively supports paid reach,
sales, or large-scale distribution.
License 3 is required if:
• the image is used in paid advertising (Paid Media)
• the project includes a defined advertising budget, duration, and media plan
• global use without territorial limitations is required
• the image appears in outdoor advertising, television, or large digital campaigns
• the image is used for merchandising (products for sale)
• exclusive rights are requested and the image must be removed from further licensing
In short:
If a company pays for the image to be shown to an audience,
License 3 applies — or an additional advertising option must be agreed upon in connection with the Business License.
